Terms of Service

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to use the Interface. By using the Interface you represent and warrant that you meet this requirement. The Interface is not directed at minors and we do not knowingly collect information from anyone under 18.

You may not access or use the Interface if you are located in, incorporated in, or a resident of any jurisdiction where use of the Interface would be unlawful or require any registration, licensing, or approval that Curvex has not obtained. This includes, without limitation, countries subject to comprehensive sanctions by the United States Office of Foreign Assets Control (OFAC), the United Nations Security Council, the European Union, or other applicable government authorities — including but not limited to Cuba, Iran, North Korea, Syria, and Russia. We reserve the right to restrict access from any jurisdiction at our sole discretion at any time.

Curvex is a non-custodial front-end interface that interacts with smart contracts deployed on the Solana blockchain. We do not custody, hold, control, or have access to your funds, private keys, or seed phrases at any time. All transactions are signed locally in your wallet and executed on-chain. You are solely responsible for the security of your wallet and credentials.

Nothing on Curvex constitutes investment advice, financial advice, trading advice, or any other form of advice. Curvex makes no recommendations regarding buying, selling, or holding any token. You are solely responsible for your own investment decisions, the risk you take on, and any resulting gains or losses.

Bonding-curve tokens are highly speculative and experimental. You may lose all funds you invest. Risks include, but are not limited to: extreme price volatility; smart-contract bugs or exploits; Solana network congestion or outages; MEV and front-running; rug pulls or malicious token creators; failed or stuck transactions; regulatory changes; and third-party protocol risks (e.g., Raydium). “Degen” and “Wave” curves are explicitly designed for higher volatility than linear curves. Only use funds you can afford to lose entirely.

You agree not to use the Interface to: (a) violate any applicable law or regulation; (b) engage in market manipulation, wash trading, or fraudulent activity; (c) launder money or finance terrorism; (d) impersonate any person or entity or submit false information; (e) upload content that is defamatory, obscene, hateful, or infringes third-party intellectual property rights; (f) attempt to circumvent geographic restrictions using VPNs or proxies; or (g) interfere with or disrupt the Interface’s operation. We reserve the right to suspend or terminate your access for any violation.

You are solely responsible for all content you submit (token name, symbol, image, description, links). You represent that you own or have the rights to all content you upload and that it does not violate any law or third-party rights. You grant Curvex a worldwide, royalty-free, irrevocable license to display and distribute your content in connection with operating the Interface. We may remove any content at our discretion.

All Interface code, design, graphics, text, and other materials are the intellectual property of Curvex or its licensors and are protected by applicable copyright, trademark, and other laws. You may not reproduce, modify, distribute, or create derivative works without our prior written consent. The on-chain smart contracts are open-source and subject to their respective licenses.

You are solely responsible for determining and fulfilling any tax obligations arising from your use of the Interface, including any income, capital gains, VAT, or other taxes. Curvex does not provide tax advice and is not responsible for reporting or remitting any taxes on your behalf.

THE INTERFACE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE INTERFACE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE UI MAY SHOW ESTIMATES — THE CONFIRMED ON-CHAIN TRANSACTION IS ALWAYS THE SOURCE OF TRUTH.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURVEX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF FUNDS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE INTERFACE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE FEES YOU PAID TO CURVEX IN THE PRECEDING 30 DAYS.

You agree to indemnify, defend, and hold harmless Curvex and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Interface; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any token you create or content you submit.

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration. You waive any right to bring claims as a class action or representative proceeding.

We may modify these Terms at any time by posting the updated version with a revised “Last updated” date. Continued use of the Interface after any change constitutes acceptance of the new Terms. We may also suspend, restrict, or discontinue the Interface at any time without notice or liability.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy and Fees page, constitute the entire agreement between you and Curvex regarding the Interface. Our failure to enforce any right or provision is not a waiver of that right. These Terms do not create any partnership, joint venture, or employment relationship.

Never share your seed phrase or private keys with anyone. Curvex will never ask for them — not in the UI, not via email, not via social media. If anyone asks for your seed phrase claiming to be Curvex support, it is a scam.
